Do the revolutionary aspects of the Internet necessitate a whole new body of law or does existing law provide the framework for application to this new technology? Steve McDonald, General Counsel for Rhode Island School of Design, Fellow of the National Association of College and University Attorneys, Charter Member of the Institute of Computer Policy and Law [former Computer Policy and Law] and expert on Internet law especially in higher education, surveys this question through a review of applicable Internet Service Provider and privacy law.

His talk, which occurred on August 11, 2008 at the opening session of the Institute for Computer Policy and Law, also includes in the second part an extended discussion of the Family Education Rights and Privacy Act. It is intended to provide the basis of understanding legal and policy issues for advanced topics during the 2008 conference and as reference for future ICPL conferences.
